as gunpoint. this happened on the first floor of this building here on 40th avenue. the victims say they often leave their front door unlocked because there's a gate. if we pan down, we can show you the gate in front of the building. that's usually locked but the residents say they admit this gate sometimes sticks and they think that's maybe how they got in. this happened before 3:00 a.m. the victims tell us there were eight people inside the building. the five men broke in and went from room to room, waking people up and bringing them into the living room. >> i've never had a gun in my face before. that was pretty intense. >> reporter: did they all have guns? >> one of them had a knife. >> one of them grabbed a knife from our kitchen and i saw two guns. >> reporter: were they covering their faces? >> no. they all had really bagby clothes on and hoods on. but you could see their faces. >> reporter: victims say they ransacked the place, they believe, looking for drugs.

they broke at least one door down and took iphones, money, photographry victim. there were five suspects. two left almost immediately after it began. two stayed and seemed frustrated by what they couldn't find. >> one of them got really missed off -- pissed off. >> he got a little -- he asked for the weed. we were like, we don't have any and then he was silent and then it was like don't give me lip and he went through and hit every boy. >> grabbed the sister by the hair. >> reporter: a kitchen knife victim says the suspects grabbed -- the knife grabbed from the kitchen was in their kitchen. the people say when their lease comes up, they are likely looking for a new place to

live. live in san francisco, claudine wong, ktvu channel 2 news. a search intensifying right now do find a missing 19-year- old sonoma county woman last scene at a new year's event in lake tahoe -- last seen at a new year's event in lake tahoe. tara moriarty has more. >> reporter: the search andreas queue effort is underway for -- search and rescue effort is underway for her right now. family and friends are up there right now. they've been posting fliers like this one in hopes of generating leads. the 19-year-old has not been seen or heard from since shortly before midnight since new year's eve. she was in lake tahoe for a snow globe, a three-day music festival. a friend says she disappeared around 11:30 and then she told her friends show was taking a shuttle back to the horizon resort. she was scotted by -- spotted by guests around midnight.

a facebook page has been set up to find her. she's studying to be a paramedics. she's described as-53, long hair died black and a fair complexion. we spoke to south lake tahoe police this morning and they say a friend of hers saw the missing page on facebook, contacted them. police contacted elissa's parents in santa rosa. that was january 1st. police say the parents were under the impression they couldn't file a missing person's report until 24 hours after their daughter went missing. police say that's not the case. if you are in that type of situation where a child or adult goes missing, you are to report it to authorities immediately. live in petaluma, tara moriarty, ktvu channel 2 news. two placer county teenagerses accused of druing one of the -- drugging one of the girl's parents to be able to use the internet.

the suspects are 15 and 16. they are accused of putting sleeping pills into a milk shake. the parents woke up the following morning feeling groggy. wrong and took a drug test. those girls were later booked at juvenile hall. the da's office will decide if they will be prosecuted as minors or adults. a court hearing is set for a driver hitting and killing two innocent people outside of a liquor store. it happened new year's eve's morning. ktvu has obtained video of the crash scene at south van ness avenue and 21st. investigators say 19-year-old david morales caused this deadly crash while he was fleeing the police following a shooting. morales described as a convicted felon and gang member is facing several charges including two counts of murder. 7:06. the fiscal cliff bill is now law. the president who is vacationing in hawaii authorized the use of the auto

pen to sign the bill for him last night back in washington, d.c. the auto pen is a mechanical device that copies the president's signature. the bill raises taxes on the wealthiest americans while preserving tax cuts for more american households. and buried in the bill is a benefit for commuters who use public transportation. it's the restoration of a exam that allows commuters to pay up to $240 of their cost with pretaxed dollars. the program was originally part of a sunshine federal stimulus package. but it was not renewed last year. a new session of congress will be sworn in today on capitol hill. coming up at 7:15, the unfinished business the new congress will have to address. >> it's a lot. >> yes. >> it is a lot. sal is back. you have the chopper flying. >> that's right. we've looking at the peninsula

and back to cold and sunny days on monday. thank you, steve. 7:10. a new policy is in place to help prevent violence at san francisco homeless shelters. shelters are allowed to close their doors to people who are violent or make threats outside of the shelter. the new policies were approved last month by the city's human services commission in response to a deadly shooting. in the past, shelters were not allowed to ban people for violent behavior. so far in 2013, the bay area has been banned from burning wood. today it's not ill real but it's strongly discouraged. today is the first day in the new year, there is not a spare the air alert. but authorities are still strongly discouraging burning wood. authorities hope this will avoid something more -- having more spare-the-air days. >> sure. 7:11. in addition to the fiscal cliff, president obama signed a new defense bill, the key part

the body of a 30-year-old man who was stabbed to death was found early yesterday morning on a street corner. it's still not clear what led up to the killing. police in oakland are releasing surveillance photos. they want you to help identify suspects from a recent bank robbery. take a look. these are pictures of two people suspected of being involved in the bank of the west robbery on telegraph avenue near 49th street back on december 10th. police say the man robbed the bank and even though no weapon was seen, he reportedly told the tellerrer, he had a gun. investigators say the woman is believed to be an accomplice. it's now day 110 of the nhl lockout. in a few hours, talks resume in the negotiations to get pro hockey players back on the ice. >> if you have aiver to -- river to cross, you -- you have to cross or figure out something else. >> on some issues we agreed and

recovering from stab wounds. the other from head trauma. janine. >> reporter: yeah, tori. it was the father who was stabbed that police told me they are still waiting to talk to the father and the son who were both pat the hospital to find out what happened here at the crown colony condo complex. this happened on the third floor of the condo belonging to the dad. police say they received a 911 call from the father who is in his mid to late 30s saying he had been stabbed. whenever officers arrived, they found he was suffering from stan wounds, one in his stomach. his son was with him and had a laceration to his head and other trauma. investigators say the two appeared to be fighting over something. they were rushed to sf general and are suffering moisture injuries. the security guard was surprised about all of the commotion because no serious crime has happened here before. >> it's a little scary. i walk around here the middle of the night and to know there's people with that

capacity is a little frightening. but you know, i still think that -- i mean, the place is relatively safe. >> reporter: investigators have gathered evidence here at the condo complex. they did recover the knife that waspsed in the attack. they are still trying to piece together what happened and trying to figure out who the aggressor was and they will have more of those answers once they figure out what happened between the father and the son. they can't right now because both are being treated for their injuries. i just spoke to the vice mayor of daly city who happens to live in the building where this stabbing happened. you will hear from him coming up in the second hour of "mornings on 2." reporting live from daly city, janine de la vega, ktvu channel 2 news. 7:31. an emergency meeting today in east palo alto. there are fears a levee will fail threatening families and homes. ktvu's brian flores is in east palo alto right now. we know that state officials

will be at the emergency meeting. brian? >> reporter: that's right, dave. state officials are expected to be here sometime today taking a look at the levee that was damaged from the last rain storm. take a look for yourself. it's been several days since that last rain storm but there's still sandbags along the creek. if we take a look at the water levels. it looks pretty low. when it rained last time back in late december, it overflowed and damaged several homes. but yeah, city officials are asking for the state's help in shoring up this levee and repairing any damage. now, just yesterday, city officials held a press conference to declare a local emergency asking for the state's help in shoring up the dirt lev ealong the -- along the creek. there was damage to seven homes as well. city officials are seeking $2.7 million to make repairs to the levy. the storms before christmas dumped so much water that water and mud spilled on the streets. there was two feet of water on the streets and 40 people had to beth have the.

sandbags were brut -- had to be evacuated. sandbags were brought in. >> i'm seeing a lot of difference in the attitudes of the people who don't live there. the people who live there are concerned. >> we've exhausted our local and regional resources in addressing the levee needs. >> reporter: city officials say because the sandbags, there isn't any immediate danger. but with the rainy season still weeks ahead, there could potent with close to half of the residents living in the floodplain, the state needs to act fast, according to residents. the emergency meet something putting that proclamation in order will be scheduled at 7:30 at the east palo alto city hall tonight. brian flores, ktvu channel 2 news. no extra security will be

added on bay area beaches after the tragic deaths of three people swept out to sea on new year's day. a man died on reyes beach upon new year's day. four days later, a father and son died after a wave swept them while fishing in the marin hedlunds. we're told there are no immediate plans to add lifeguards or extra patrols. happening now, students from sandny hook elementary are back at school. it's the first time classes have been held since last month's tragic shooting in newtown, connecticut. our reporter is live in connecticut with more on what teachers are doing to try to help these young students ajust. >> good morning, tori. you know, we spoke to one of the moms who describes the day as amazing. she said the hallways are filled with volunteers and

counselors and therapy dogs. so if any child feels -- feels anxious, they can pet the dog. there's so much support from this new school where it's been completely refurbished. everyone says the kids and the parents, they are doing well. remember, they put this together over holidays but they came with everything they needed to sort of get this school going. it's a big deal especially because of all of the anxiousness and the trepidation. we spoke to one parent. you were in the gym and artroom. they heard the gunshots and screams that horrible morning at sandy hook elementary school. three weeks isn't enough time to understand all of things that have experience -- all of the feels experienced since then -- feelings experienced since then. >> going back to school is a

big part of the healing. you are looking forward to -- are you guys looking forward to going back to school? >> we went and looked at everything. it's a very interesting school. >> reporter: originally for teenagers, the school in monroe has been transformed from k to 4th grade. familiar things brought over from sandy hook. >> all of the desks are there, my desk, i noticed someone was in there and cleaned it and -- not cleaned it, made it neater. my desk is usually very messy. >> i think them gettingp on the -- getting on the bus, for us it's a movement forward. this is the next step. now it's getting back to a routine, getting them to school so they get back to the normalcy and start learning again and be who they are. >> reporter: ben and eaton want the school turtle to be the mascot. >> our motto that could go with

it is actually one step at a time. >> reporter: it's also one step at a time for moms and good friends denise and sara and their daughters. >> there's no real playbook for this. i don't think any of us really have a playbook. we're kind of just sensing our child and trying to meet the needs that we can. >> reporter: counselors will be on hand for the children and parents can spend the day at the school, just in case. >> i joked with one of the other moms. i will see you in the morning. i will bring coffee. i -- i think i need that adult time, too. i think my peace has been shattered. >> reporter: ben and eon this did tell us that the -- ethan did tell us the days are better during the day. during the day, they are occupied and at night, it gets trickier and that's when the anxiety and worry set in. ethan said he used to be afraid of monsters.

now he's afraid that someone is gonna come who shouldn't be there. tori? >> those kids are amazing. you talk about their fears. has there been any progress in the investigation as to why this tragedy happened in the first place? >> reporter: no, police are still investigating. the toxicology report is still not back yet or they are not being released yet. we don't know if there was something in his system that triggered his behavior, what he did, why he did it. that's still under investigation. it could take months before we know exactly the motive in all of this. remember, tori, he had a computer, he smashed it to bits and erased every sign of why he may have done this. >> all right. thank you. it is 7:38. polly klass was just 12 years old when she was kidnapped at knife point during a slumber

party and murder -- and murdered in 1993. today would have been her 32nd birthday. coming up, the foundation named after her prepares to make a imagine poor announcement and a look at the technology aimed at keeping today's children safe. 7:38. on a lighter note, tonight we're gonna get a look at the project that's installing thousands of new lights all other across the bay bridge. we'll be talking to the people installing 125,000 lights creating a dazzling show across the western span of the bay bridge. this should all be finished by march. it will light up the bay for two years. the final numbers are in for the new year's holiday weekend crackdown on drunk drivers. all over the state, more than 1400 drivers were arrested. that's up from 1270 last year. here in the bay area, there were 208 dui arrests, about the same as last year. there was only one fatal crash here in the bay area compared to three in 2011. all right. well, sal's been telling us things are okay so far on the

kind of growhouse or something before we moved in. >> reporter: the victims were held at gunpoint for about 15 minutes and say five people initially broke in but only three stayed. they say the group seemed to be frustrated when they didn't find drugs. they say they hit the guy, pulled the hair of the girls. and they took laptops, phones, ipads, money and photographpry equipment but then left and the victims say they were able to call 911 after that. they say one of the suspects also grabbed a knife from the kitchen. that kitchen knife was found in this planter box right in front of the building. police were out here this morning for a couple of hours. they would not say much only to say their investigation was underway. and they are currently looking for the five suspects described only as black men in their 20s. claudine wong, ktvu channel 2

news. a petaluma woman disappeared during a music festival. tara moriarty is in petaluma where family and friends are missing -- are worried sick. >> reporter: we're waiting to talk to one of the friends of melissa bush who went missing on new year's eve. there are discrepancies about when police were notified about the case. if you look over here, this is alist -- elissa burn. a search and rescue effort has gotten underway in south lake tahoe. friends and family are helping folks out there, they are hoping to get some leads with the fliers. 19-year-old burn has not been seen or heard from since shortly before midnight on new year's eve according to -- according to friends with her. a friend said she disappeared from the mikic festival and then she told a friend she was

taking a shuttle back to the resort. a facebook page has been set up to find her. she worked as a hostess at calleman's restaurant here in petaluma and was studying to be a firefighter. again she's described as 5'" 3, 125 pounds with blue eyes, long hair died black and a fair complexion. the douglas county sheriff's department is handling the case. meanwhile, her older brother and father are in tahoe helping authorities and are thanking law enforcement and friends for their support. we are speaking to -- hoping to speak with the family coming up later. tara moriarty, ktvu channel 2 news. 8:03. new this morning, just hours ago, police in the sacramento area shot and killed a suspected car thief. now, it happened about 2:00 this morning in citrus heights. a nabor reported hearing a commotion, called the police after seeing two men driving up

in a truck and then breaking into another car. when the police arrived, they say the men were trying to steal things from that car. the police officer fired his gun, says there was a confrontation and that he feared for his life. >> the call came out at suspicious subjects, possibly a vehicle theft and when officers arrived on scene, there was some question as to when and where the second suspect was located. now, there's no word yet on the condition of that suspect. no police officers were hurt. the second suspect was arrested. new details on what may have led to that deadly new year's eve shooting at a sacramento bar. the daughter of the victim claims her father accidentally spilled a drink on a friend of carlos montoya, the alleged gunman. she claimed her father tried to apologize for it. but police say montoya shot and killed cordova. 36-year-old daniel ferrier who worked as a bartender was also

filled. carlos montoya is in custody. after harsh criticism, even from fellow republicans, house speaker john boehner has now scheduled votes on aid for victims of superstorm sandy. boehner cabs. ed a schedule vote on sunday night because of the long fiscal cliff legislation. republicans from new york and new jersey reacted with outrage. now there is a vote scheduled tomorrow on a $9 billion bill to help pay for flood insurance claims. a second vote will be held january 15th on another $51 billion aid package. homeless advocates will occupy the steps of the cap to to -- capitol to raise attention. supporters say more cities are enforcing laws that attack the homeless such as bans on sitting and lying on streets and sidewalks. registered nurses and healthcare workers had protested before and now they

are holding a press conference in oakland to announce how they plan to deal with employer attacks. they say they've dealt with medical employers attacking their health benefits and staffing levels. the california nurses' association and healthcare workers union will now speak out about their plans to deal with these problems. 8:05. well, governor jerry brown wants to change the way california schools are funded. a proposal calls for funding more districts as well as allocating those with en-- those who are low-income earns and slow earners. with the passage of tax hikes, the school board may be more receptive now. 8:06. let's check in with sal, see how things are moving and what they are looking like at the toll plaza. >> it's light. i have a feeling people are gonna be in for a rude surprise when they are expecting this at

monday. 8:09. a troubled nightclub in walnut creek is officially closed. the vice ailer lounge shut down january 1st. it all happened after the city council ordered the club to move its last call to 11:p.m. instead of 1:15. walnut creek residents have reported dozens of incidents there, including fights. according to the paper a fight broke out outside of a restaurant on maine street early tuesday morning. one man is accused of elbowing a police officer in the face and damaging the mirror on the police car. he also faces public intoxication charges, along with another man. there is a third man accused of damaging someone's cell phone. several other people suffered minor injuries. 8:10. federal investigators say it could take months before they discover what caused a fiery and smoke-filled plane crash in las vegas.

hands. 26-year-old louise ricardo hernandez has been in jail since monday. he's accused of committing the city's 46th and final homicide of 2012. hernandez was arrested for the shooting death of 36-year-old christopher soriano in the parking garage on lewis road. police say hernandez was trying to detain soriano who he believed was robbing cars in the neighbor. one of the three men accused of killing the former owner of saratoga's mountain winery is due in court. the 66-year-old was killed in his montion back on -- mansion back on november 030th. his wife was beaten -- november 30th. his wife was beaten. a coin collection, jewelry andry and cash were all stolen during that robbery. 8:17. new this morning, subaru is recalling more than 600,000

vehicles because they may catch on fire. the recall affects all 2010 and 2011 outback and legacy cars. also included are tribeca suvs from 2006 through 2012 and forrester suvs. the concern is the lights beneath the doors can overheat and cause a fire. subaru will install an extra fuse free of charge. u.p.s. says yesterday was its busiest day for holiday returns. the shipping company says it took more than 500,000 packages back to retailers. the company says that's because people were probably trying to wrap up their to-do lists. the work is not done yet. u.p.s. expected to ship 2 million packages back to store before the weekend is over. microsoft won the where for a low profile silicon valley startup. it goes by id 8 r 2 studios.

welcome back. one man is recovering in a san francisco hospital after police say he was stabbed by his own son just hours ago. ktvu's janine de la vega just talked to police to see if they

have -- an update. what do you know? >> reporter: well, police tell me that nobody has been arrested just yet and that's because they are still waiting to talk to the father and the son who are at the hospital and being treated for their injuries. this all happened on the third floor of a building here at the crown colony condominium complex, a quiet gated community off hickey boulevard. police received a 911 call from the father in his made to late 30s saying he had been stabbed. when officers arrived, they found he was stuffing -- suffering from four stab wounds. his 19-year-old son was with him and had laceration and a trauma to his head. investigators say the two appeared to have been fighting over something. they were rushed to san francisco general and are suffering from nonlife- threatening injuries. the vice mayor lives in this condo complex and he said he was shocked that his neighbors got into a violent fight. i've always, always felt safe here. but to sort of wakeup and --

although it wasn't in our unit or a random act of violence but to see something like that happen is extremely dismaying and disappointing. >> reporter: investigators had gathered evidence at the condo. they did recover the knife used in the attack. they are still trying to piece together what happened and trying to figure out who the victim is and who the aggressor was. again, they won't have those answers until they talk to both the father and son at the hospital. but they said it's very possible that at least one of them will be facing felony charges. reporting live from daly city, janine de la vega, ktvu channel 2 news. >> thank you. 8:32. placer county teenagers are accused of drugging bun of the girls' parents just -- one -- of drugging one of the girl's parents just to use the internet. the suspects are accused of putting -- of putting sleeping pills in a milling shake. the parents woke up feeling groggy and took a drug test.

they were booked into juvenile hall. the district attorney will decide whether they will be tried as minors or adults. the driver accused of of hitting and killing two -- of hitting and killing two innocent people at a liquor store is set to be arraigned today. ktvu has obtained amateur video of the scene at south van ness and 21st. investigators say 19-year-old david morales caused the deadly crash while racing away. the convicted felon and gang member faces several charges including two mounts of murder. a major emergency -- two counts of murder. a imagine poor emergency about growing fears that a levee may break. the focus will be on getting money from the state for repairs. brian flores has more. >> reporter: it's been several days since that rain storm in december. city officials and residents are not taking chances. let's take a look. sandbags remain here along the creek. if you look at the water levels

in the creek, it's pretty low now, but defending if -- depending if there's another rain storm, the levee could break. they are asking for the state's help to shore up any damage from the rain storm so it doesn't flood any of the streets. yesterday, city officials held a press conference to declare a local emergency asking for the state's help shoring up creek. not only was there damage to the levee but seven homes were damaged. officials are seeking $2 million to make repairs. the storms before christmas dumped so much water that mud and debris spilled on the streets. there was 2 feet of water on the streets and 40 people had to be evacuated. sandbags remain here today. residents want results. city officials don't want to take any chances. >> i'm seeing a lot of indifference and blase attitudes from people who did

stocks are mixed today after the dow posted its strongest gain in more than a year due to a mixed row tail report and the process of a new budget battle in congress.

investors really waiting for the monthly jobs report. the figures often move markets as they are a key indicator for the health of the u.s. economy. taking a live look at the big board, the dow is down 7. s&p up 1. 8:43. google expecting good news today. but as ktvu's pam cook tells us from our newsroom, this may be bad news for some other big names in business. what's going on? >> well, a two-year fight with the government and its rivals may come to an end with google. according to bloomberg news an agreement with the federal trade commission is expected to be announced today. it is said to be a significant blow to google's competitors. that includes bing, microsoft and yelp. they are three of the companies that have been asking the federal government for years to go after google in an anti- trust lawsuit. now, google dominates the search business with 70% of the market share. its rivals claim it's used that to unfairly compete against them. now, google says its search

engine is better than the others. it also argues that u.s. anti- trust laws are designed to protect consumers, not the competition. google's stock is now up $7.25, up more than 1% for the day. bloomberg also reports in the deal which is supposed to be announced today, google will make some changes to certain search practices. but certainly investors looking at this as good news. reporting live in the newsroom, i'm pam cook. let's go back to tori and dave. there are reports that google's executive chairman will travel to one of the last frontiers of travel space. eric schmidt will be going to north korea on a private humanitarian mission. it may happen as early as next month. the mission will be led to bill richardsonson. that would be the -- richardson. that would be the country  considered to have the most restrictive internet policies in the world by any top google

the hair. >> reporter: a kitchen -- the kitchen knife grabbed by the suspect was recovered from the planter box in front of the building. the college students only lived here for less than a year. and they think this may have been a growhouse or something that led the suspects to believe thermight be drugs here. their lease comes up next month. they will likely be booking for a new place to live. live here in san francisco, claudine wong, ktvu channel 2 news. >> thank you. 8:49. happening now, children from sandy hook are back in school for the first time since last month's tragic shooting in newtown, they are attending classes in a neighboring town at a school that's been transformed to look like sandy hook. teachers and staff spent weeks getting it ready for the children. they brought in desks, backpacks and other items from the campus to make the children feel more comfortable. >> the staff made that decision and the staff believes that this gives them there their identity and a comfort level.

that's what we want. >> reporter: teachers have been told not to talk to the children about the shooting but grief counselors are on hand if any child needs some support. the newtown superintendent says it will be up to the community to decide what to do with the sandy hook campus where a gunman killed 20 children and six adults three weeks ago. new this morning, from switzerland, three women were killed and two men were hurt after a gunman opened fire in a village. the gunman himself was shot and count -- and wounded by police after they say he pointed a gun at them. he's under arrest. authorities say he used two weapons in the attack including a vintage army rifle. the motive is unclear but authorities say he knew some of the victims. police say they confiscated weapons from this same man back in 2005 when he was placed in a psychiatric ward. 8:50. i have to tell you, you know it's cold. steve's been telling you. we had freezing temperatures in the bay area overnight.

just a couple of minutes ago, we received an update about a missing petaluma woman last seen in lake tahoe on new

year's day. tara moriarty just talked to the mother of 19-year-old elissa burns. what did she say? >> reporter: she's very worried but does remain hopeful her daughter will be found. her husband as well as many of elissa's friends are up in lake tahoe taking part in a search and rescue mission up there in the area. and kim burn and her son remain here at the home -- at the home praying for the 19-year-old's safe return. there have a lot of fliers posted in petaluma. she's not been seen or heard from since shortly before midnight on new year's eve. she was in lake tahoe for snow globe, a three-day music festival. a friend said she disappeared from the group around 11:30 and then by phone told her friends she was taking a shuttle back to the hole tell. she was spotted by guests in the casino at the horizon resort casino around midnight.

>> i'm gonna try hard not to come up with some form of punishment when she comes home. >> you think that she's okay? >> i'm very hopeful that she'll be home. and that's -- that's -- there's no other option for me. >> reporter: now, a facebook page has been set up to find burn who worked as a hostess at cattleman's restaurant in petaluma. she was also studying to be a paramedics firefighter at the santa rosa jc petaluma campus. she's described as 5'3", 125 pounds with blue eyes and long hair died black with a -- dyed black with a fair complexion. her mother said she was hesitant about the festival but she says she trusts her daughter. she's been a great kid and has been texting her every day while she was away. she's not considered at risk. her family is thankful for the support of friends and law enforcement. we'll have much more on this
